The Court held that the insurance company cannot be entirely exonerated from liability merely because a vehicle carried one passenger more than its licensed seating capacity; instead, it is liable to satisfy the highest claims up to the permitted limit and can recover excess payouts for remaining claimants directly from the owner. Furthermore, modifying the Tribunal’s awards, the High Court recalibrated future prospects to 40% for self-employed/unorganized sector workers below 40 years of age and standardized conventional heads strictly in accordance with the Supreme Court’s mandate in National Insurance Company Ltd. v. Pranay Sethi.
• Insurers’ Liability on Overloaded Vehicles: Following the precedents in Anjana Shyam and K.N. Poonam, the Court ruled that when a vehicle carries more passengers than its licensed capacity (4+1 seating), the insurer must satisfy the highest awards matching the policy limit, and pay-and-recover the balance for extra victims from the owner without being completely absolved.
• Future Prospects Restricted to 40%: The Tribunal’s grant of a 50% increase for future prospects was modified to 40% for victims under 40 years old working in the unorganized or self-employed sector, pursuant to the Constitution Bench guidelines in Pranay Sethi.
• Standardization of Conventional Heads: The Court struck down inflated tribunal awards for funeral costs, loss of consortium, and loss of love and affection, setting them to fixed standard thresholds: Rs. 15,000 for loss of estate, Rs. 15,000 for funeral expenses, and Rs. 40,000 for spousal/parental/filial consortium per dependent.
• Modification of Individual Awards: Interest rates across all petitions were reduced from 9% to 7.5% per annum, with individual compensation amounts adjusted across the appeals (some reduced and others enhanced) to reflect just and legal compensation.
