The State of Himachal Pradesh filed Criminal Appeal No. 469 of 2015 against the judgment of the Additional Sessions Judge, Kullu, acquitting the respondent, Sunil Kisku, under Section 307 of the Indian Penal Code (IPC) and Sections 25 and 27 of the Arms Act, while convicting him under Sections 324 and 326 of the IPC. Simultaneously, the State filed Criminal Appeal No. 358 of 2015 under Section 377 of the CrPC seeking enhancement of the sentence awarded under Sections 324 and 326 IPC. The High Court dismissed both appeals, affirming the trial court’s judgment. It held that a sickle (darat) is not a “prohibited arm” under the Arms Act without Central Government notification, that the essential mens rea for an attempt to murder (Section 307 IPC) was absent in this spontaneous altercation, and that no grounds existed to interfere with the sentencing discretion.
- Inapplicability of the Arms Act:
- A darat or sickle does not fall within the definition of “prohibited arms” under Section 2(a)(i) of the Arms Act, 1959.
- In the absence of any notification specifying a sickle as a prohibited arm under Section 7 or requiring a specific license for possession, the acquittal under Sections 25 and 27 of the Arms Act was upheld.
- Absence of Intent for Attempt to Murder (Section 307 IPC):
- To sustain a conviction under Section 307 IPC, the prosecution must establish the concurrence of mens rea (intention or knowledge to cause death) followed by actus reus.
- The gravity or dangerous nature of an injury alone is not determinative of an attempt to murder.
- Since the respondent was a stranger to the area with no prior acquaintance, motive, or premeditation, and the attack was entirely spontaneous, the acquittal under Section 307 IPC was fully justified.
- No Grounds for Sentence Enhancement:
- The incident occurred spontaneously without a premeditated plan or personal grudge, and the respondent had already served the substantive sentence awarded by the Trial Court.
- The Court found no perversity or infirmity in the quantum of sentence awarded under Sections 324 and 326 IPC and dismissed the appeal for enhancement.
- Final Disposal: Both Criminal Appeal No. 358 of 2015 and Criminal Appeal No. 469 of 2015 were dismissed, trial court records were ordered to be returned, and the respondent’s bail bonds were discharged.
