This writ petition (originally filed before the State Administrative Tribunal and later transferred to the High Court of Himachal Pradesh) was instituted by 58 Health Educators challenging a notification dated January 30, 2016. By this notification, the State granted them a re-revised pay structure with a Grade Pay of Rs 4,200 prospectively from February 1, 2016.
The petitioners argued that this action created a gross pay anomaly because:
- It equated their higher promotional posts (Health Educators) with their lower feeder posts (Male/Female Health Supervisors) by granting both the exact same Grade Pay of Rs 4,200.
- The feeder category and various other categories had already been granted this re-revised scale earlier, effective from October 1, 2012, whereas the petitioners were subjected to an arbitrary delay and prospective application through a “pick and choose” approach.
The High Court allowed the petition, holding that the State’s actions violated Articles 14 and 16 of the Constitution of India.
- Violation of Statutory Hierarchy: The State is legally obligated to ensure that the pay structure of a higher or promotional post does not fall lower than or equal to that of its feeder cadre. Treating unequal posts (governed by separate statutory Recruitment and Promotion Rules under Article 309 with distinct qualifications and responsibilities) as equal is impermissible.
- Ineffectiveness of Executive Change without Rule Amendment: An expert committee report or executive cabinet decision cannot alter the statutory nomenclature of a post from “promotion” to “placement” or override extant statutory rules without formally amending the underlying Recruitment and Promotion Rules in accordance with the law.
- Arbitrary Pick-and-Choose Cut-off Dates: Rule 1(ii) and Rule 9 of the 2012 Re-revised Pay Rules cannot be weaponized to exercise unbridled discretion, adopting a “pick and choose” approach that inflicts hostile discrimination on a section of employees without a valid classification or nexus to the object of the rules. These provisions were accordingly read down.
- Misapplication of Rule 8: Rule 8 of the 2012 Rules provides an overriding effect strictly over specific prior pay rules and Fundamental Rules, not over statutory Recruitment and Promotion Rules framed under Article 309. It cannot be used to render statutory service conditions otiose.
- Relief Granted by the Court:
- The impugned notification dated January 30, 2016, granting prospective pay from February 1, 2016, was quashed and set-aside.
- The State was directed to re-visit the matter and grant an appropriate proportional higher Grade Pay over and above the feeder category w.e.f. October 1, 2012.
- Pay fixation shall be done notionally from October 1, 2012, with actual monetary benefits restricted to three years preceding the filing of the writ petition, along with all consequential benefits.
