Specific Performance – Sale of Land – For the sale of land measuring 7 kanals 13 marlas, located in Mauza Gogharwal, Pargana and Tehsil Nalagarh, District Solan, H.P.In addition to specific performance, the plaintiff sought permanent prohibitory injunction restraining the defendant from selling, transferring, or encumbering the said land.
The plaintiff alleged that an agreement was made on 22.10.2005, wherein the defendant agreed to sell the land for Rs. 1,02,00,000, of which Rs. 15,00,000 was paid as earnest money. Further payments of Rs. 5,00,000 each were made on 22.4.2006 and 22.8.2006, extending the last date for execution and registration of the sale deed to 22.2.2007. The defendant contested the suit, alleging that the plaintiff failed to fulfill his obligations under the agreement. The defendant claimed that notices were issued to the plaintiff demanding payment of the balance sale consideration, which the plaintiff failed to comply with. The defendant also alleged that the plaintiff manipulated the agreement and did not approach the court with clean hands.
The court found in favor of the plaintiff on the issue of specific performance, holding that the agreement was valid, and the plaintiff had fulfilled his obligations. The court rejected the defendant’s contentions of non-payment and manipulation of the agreement. Consequently, the court decreed the suit in favor of the plaintiff, granting the relief of specific performance as prayed for. (Para 86, 87, 88)
