It is revealed that the transfer of the petitioner was ordered based on directions from a higher authority without independent assessment, rendering it arbitrary.
The court appreciates the admission by the Learned Advocate General regarding the lack of impartial application of mind in the petitioner’s case.Consequently, the court quashes the impugned transfer order and grants liberty to the State Authorities to reconsider the matter in accordance with the law and the requirements of public interest and administrative exigencies.(Para 9)
