The petitioner, initially appointed as a Medical Officer in 1992, had his seniority revised after several years without prior challenge. The review of seniority lists and promotions was initiated based on a representation filed belatedly. The petitioner argued that the delay in challenging the seniority lists and the lack of opportunity for a pre-decisional hearing violated the principles of natural justice. The court observed that seniority lists, unchallenged for several years, should not be disturbed without valid reasons. Additionally, it emphasized the importance of providing the petitioner with an opportunity to respond to the representation before making any changes. Considering these factors, the court quashed the impugned notification and directed the restoration of the petitioner’s seniority with consequential benefits. (Para 19)
