Service Law – Dismissal – Scope of judicial review in disciplinary proceedings – Principles of natural justice – Disproportionate punishment – The appellant, the legal representative of the deceased delinquent officer, contested the dismissal on grounds of procedural irregularity and disproportionate punishment.
The Court emphasized the limited scope of judicial review in disciplinary matters, stating that the Court cannot reassess evidence like an appellate court. It reiterated that interference with disciplinary action is permissible only if there is a violation of natural justice or statutory regulations, or if the decision is arbitrary, capricious, or malafide.
Referring to precedents, the Court highlighted that punishment must shock the judicial conscience to warrant interference, and courts must record reasons for finding punishment disproportionate.
In the present case, the Court found the charges against the delinquent officer serious, indicating his negligence and violation of bank regulations, justifying the penalty of dismissal. Therefore, the Court upheld the impugned judgment, finding no illegality or infirmity, and dismissed the appeal along with any pending applications. (Para 25)
