The petitioner contended that the list was prepared using amended rules retrospectively, which was erroneous.
The Court examined Rule 15(A) and 15(B) of the Himachal Pradesh Revenue Department (Mohal Class-III Non Gazetted) Recruitment & Promotion Rules, 1992, which clearly stated that seniority for Patwari candidates was based on merit obtained in selection tests, not on marks obtained in Patwari examinations.
Contrary to the amended Rule 15, which altered the basis for seniority, the Court held that retrospective application of the amended rule was impermissible unless explicitly stated. Citing precedent, the Court emphasized that statutes are presumed prospective unless expressly made retrospective.
The Court quashed the rejection order of the petitioner’s representation and the final seniority list prepared using amended rules. It directed the authorities to prepare the seniority list based on the rules prevalent at the time of recruitment, placing the petitioner above the private respondents. (Para 20)
