- Statutory Preference for Helpers: Under Rule 5 of the Notification dated 19.06.2010, when a post of Anganwadi Worker falls vacant, an Anganwadi Helper working at that specific center is entitled to the “first opportunity” for appointment, provided she meets the minimum educational qualifications.
- Weightage of Promotion Over Transfer/Adjustment: While Rule 4 permits the adjustment of an Anganwadi Worker or Helper upon marriage at her husband’s residence, it does not grant an unfettered right to override the promotion prospects of existing local employees. The rule of consideration for promotion holds greater weightage.
- Legitimate Expectation: An employee who has rendered extensive service (such as 24 years) at a specific center builds a legitimate expectation for promotion, which cannot be arbitrarily swept aside by transfer adjustments influenced by extrinsic means.
- Final Outcome: The Letters Patent Appeal was dismissed, affirming the direction to grant the appointment/promotion to the original writ petitioner from the due date along with consequential benefits.
