Service Law – Pay Scale – The petitioners, Technical Assistants formerly designated as Statistical Assistants in the Horticulture Department of the State of Himachal Pradesh, sought the applicability of a decision rendered by the Himachal Pradesh Administrative Tribunal and affirmed by the High Court. The decision entitled the post of Technical Assistant to a revised pay scale of Rs.2000-3500 w.e.f. 01.01.1986. While the respondents implemented the decision for one petitioner, they denied it to the others, leading to the present petition. The Tribunal and the High Court had previously held that denying the revised pay scale to Technical Assistants was discriminatory and against principles of natural justice and fair play.
The Court relied on precedents emphasizing the principle of treating identically situated persons alike in service matters to avoid discrimination.The Court cited relevant judgments emphasizing the duty of the State and its instrumentalities to extend the benefit of judicial pronouncements delivered in rem to all similarly placed employees.The Court allowed the petition, quashed the impugned decision of the Finance Department, and held the petitioners entitled to the revised pay scale of Rs.2000-3500 w.e.f. 01.01.1986. The petitioners were also granted benefits from three years prior to the filing of the writ petition along with interest on arrears . (Para 5)
