Service Law – Non-review of suspension within prescribed period – Petitioner, a TGT (Arts) at Government Senior Secondary School, Baneta, District Chamba, placed under suspension following registration of FIR against him – Suspension order issued on 30th May, 2023 – Petitioner released on bail on 27th June, 2023 – Headquarters initially fixed at Deputy Director of Elementary Education, Chamba, District Chamba, subsequently re-fixed at Directorate of Elementary Education, Himachal Pradesh, Shimla – Petitioner contends suspension became invalid on expiry of 90-day period as per Rule 10 of Central Civil Services (Classification Control and Appeal) Rules, 1965 – Respondents failed to review suspension within stipulated period – Held, failure to review suspension within prescribed period renders suspension invalid and inoperative – Citing Union of India and others vs. Dipak Mali (SLP(C) 6661 of 2006) – Respondents directed to examine suspension order in light of Rule 10 and Dipak Mali case – If suspension not reviewed within 90 days, deemed invalid – Petitioner entitled to all benefits – Writ petition disposed accordingly.
