- A condition in a government notification stating that staff from taken-over colleges shall be treated as “fresh entrants” placed at the bottom of the seniority list is designed solely to protect the existing seniority of regular government employees.
- This condition cannot be interpreted to deprive taken-over staff of the credit of their past service for computing pensionary and retiral benefits in the absence of a specific exclusionary clause.
- Position Akin to Government Posts:
- Following the Supreme Court’s jurisprudence, a teacher in a government-aided institution holds a position “akin to a post under the State Government” for all practical purposes, including entitlement to monetary benefits, pay allowances, pension, and gratuity.
- Final Directions:
- The respondents were directed to count the entire service of the petitioners from their initial dates of appointment in the aided college for all retiral benefits (pension, gratuity, and leave encashment).
- Arrears must be disbursed within three months, failing which simple interest at the rate of 6% per annum will apply from the date of the judgment until actual payment.
