Himachal Pradesh Education Department, Class-III (School and Inspection Cadre Services) Rules, 1973 – Service Law – Fundamental legal right to regular appointment – Contractual appointment – Assured Career Progression Schemes – The petitioners sought regular appointment as Trained Graduate Teachers (TGTs) from the initial date of their contract appointment, contending that their contractual appointments were contrary to the Recruitment and Promotion Rules of 1973. The petitioners argued that they had a fundamental legal right to be appointed on a regular basis.
The High Court noted that similar issues had been adjudicated in previous cases such as Om Parkash v. State of Himachal Pradesh, Manju Devi v. State of Himachal Pradesh, and Anju Devi v. State of Himachal Pradesh. These cases affirmed that appointments made in contravention of the Recruitment and Promotion Rules, especially when the contractual mode of appointment was introduced after the selection process, were irregular. The court directed the concerned authority to verify the facts and, if the petitioners were found to be similarly placed as in previous cases, to extend the benefit of deemed regular appointment along with monetary benefits in accordance with the law.
