Petitioners seek parity in salary, regularization of employment, and counting of contractual services towards their regular services, which the respondents deny based on their contractual status and affiliation with a voluntary organization.
Despite orders from the Division Bench and the Secretary (Social, Justice and Empowerment), the respondents failed to comply, leading to further litigation. Refusal to regularize services and denial of equal pay and pension to employees working for extended periods on contract terms is against public policy. The court criticizes the respondents for their indifference to the welfare of employees, highlighting the importance of trust and fairness in employer-employee relations.
In view of the principles laid down by various judicial precedents, the court finds the respondents’ actions lacking in social conscience and fairness.The court directs the respondents to provide equal pay, regularization, and pension benefits to the petitioners, citing the State’s responsibility to ensure free education and support for specially abled children.
