Service Law – Concealment of Information – Attestation Form – Termination The institute terminated the petitioner’s services based on alleged false information provided in the Attestation Form regarding criminal cases pending against him. However, the petitioner argued that he had not concealed any information as the form did not specifically inquire about FIRs, and he had answered truthfully based on the questions posed.
After considering the arguments, the court held that the petitioner had not furnished wrong information or concealed facts while filling the Attestation Form. The questions in the form did not explicitly require disclosure of FIRs, and since no charge sheets were filed at the time of filling the form, the petitioner’s responses were truthful. Consequently, the court quashed the termination order and directed the institute to reinstate the petitioner as an Office Assistant in accordance with the initial selection order. This judgment emphasizes the importance of clarity in application forms and the obligation of institutions to ensure that questions are framed explicitly to solicit accurate information from candidates.
