Indian Penal Code, 1860 – Section 302 read with Section 34 – Quashing of Charges – Not quashed – Right of Private Defence – The High Court upheld the order of the trial court, which framed charges against the accused for the commission of offences under Section 302 read with Section 34 of the IPC and Section 25 of the Arms Act.
The accused, while claiming self-defence, allegedly shot the victim during a dispute over property demarcation, resulting in the victim’s death. The Court emphasized that the trial court is not obligated to provide elaborate reasons while framing charges but must ensure sufficient material exists on record.
It was observed that mere firing in the air during a property dispute does not automatically justify invoking the right of private defence extending to causing death.The Court clarified that aiming a shot towards a vital part of the body, resulting in death, indicates an intention to cause death, justifying framing of charges under Section 302 of IPC.
Holding that the trial court’s order was supported by the charge-sheet and devoid of infirmity, the High Court dismissed the revision petitions. (Para 14, 15, 16, 30, 31, 32, 33)
