The appellant contended for acquittal based on parity with a co-accused who had been acquitted earlier.
The prosecution relied on the testimonies of police officials and argued for an independent assessment of evidence against the appellant. The court considered previous judgments emphasizing that the acquittal of a co-accused does not automatically lead to the acquittal of others unless the entire prosecution case suffers from infirmities. It highlighted that similar or identical evidence against two accused should be decided alike, applying the principle of parity.
The court found that the evidence against the appellant was identical to that against the acquitted co-accused and concluded that applying different parameters would result in a travesty of justice. Consequently, the court allowed the appeal, set aside the judgment and sentence, acquitted the appellant of all charges, and directed his immediate release. (Para 27, 30)
