Prevention of Money Laundering Act, 2002 – Section 3, 4 – Bail – Money laundering – Predicate offences – Proceeds of crime – The applicant, a sitting MLA and a professional sports person, was implicated as an accused under Sections 3 and 4 of the Prevention of Money Laundering Act, 2002, arising from three FIRs related to predicate offences.
The investigating agency alleged that proceeds of crime were generated from the predicate offences, primarily FIR No.129 of 2020, where M/s. Vikas Construction was accused of encroaching on public property.
Despite not being directly charged in some FIRs, the applicant’s alleged association with family members involved in financial transactions formed the basis of the money laundering allegations.
The applicant’s bail application contended that he had no direct involvement in the business affairs of M/s. Vikas Construction and lacked knowledge of the source of funds transacted through his account.
The court observed the wide definition of “proceeds of crime” under the PMLA and the requirement of establishing a connection between the accused and the alleged criminal activities.
While bail is a statutory right, its grant is subject to the court’s satisfaction that the accused is not likely to commit further offences and that there are reasonable grounds to believe in the accused’s innocence.
Despite the applicant’s arguments, the court found prima facie evidence linking him to the movement of funds and the alleged money laundering activities.
The court considered factors such as the seriousness of the offence, the applicant’s family background, and his cooperation during the investigation.
Ultimately, the bail application was rejected, with the court directing expedited trial proceedings and discouraging unnecessary adjournments by the prosecution. (Para 42 and 43)
