The Joint Secretary, Commerce and Industries Department, West Bengal, vide order dated 13.03.2003, rejected the application of Respondent No. 1 – M/s. Chiranjilal (Mineral) Industries of Bagandih, on the ground of non-availability of land in view of the previous application of WBMDTCL. (Para 2.3)
Whether the letter for approval dated 22.05.2014 granted by the State Government can be treated as a Letter of Intent predicated on the words by whatever name, which expression, it was submitted, should be given a broad interpretation in view of the words ‘by whatever name called’ was examined indepth and in detail. (Para 15)
Having said so, it is the stand of the appellants – State of West Bengal, that they are owners of 20.87 acres of the land in question and to this extent, they have no difficulty in executing the mining lease. (Para 20)
With a direction that the government of West Bengal will execute a mining lease for 20.87 acres of land in favour of the Respondent No. 1 – M/s. Chiranjilal (Mineral) Industries of Bagandih. (Para 22)
