The petition was primarily directed at her son, Raghubir Singh, who was the respondent No. 1.
The petitioner alleged neglect and refusal to maintain her, claiming that she was forcibly thrown out of her house and was residing with one of her sons, Gurmeet Singh, who was not adequately providing for her needs.
During the proceedings, the petitioner’s other sons accepted the claim and agreed to pay maintenance, but Raghubir Singh contested the petition, citing financial constraints.
The Additional Sessions Judge set aside the maintenance order passed by the Magistrate, stating that the essential ingredients required for granting maintenance were not proven to exist at the time of passing the order.
The Court elucidated that the essential ingredients for granting maintenance include the respondent having sufficient means, neglect or refusal to maintain the claimant, and the claimant’s inability to maintain herself. These ingredients must coexist at the time of passing the order.
It was observed that the petitioner was receiving maintenance from her other sons, Gurmeet Singh, Nirmal Singh, and Pritam Singh, totaling Rs. 13,000 per month. Despite the petitioner’s claims of financial hardship, the evidence suggested otherwise, as she was residing with Gurmeet Singh, who was providing for her needs. The Court emphasized that moral duty alone, without statutory force, cannot compel maintenance payments under Section 125 of the Cr.P.C.
Considering the circumstances and the relationship between the mother and son, Raghubir Singh was directed to pay Rs. 2000 per month to his mother from November 1, 2023, in addition to the maintenance already being received from her other sons. The Court also allowed either party to seek alteration or modification of the maintenance amount in the future, based on changed circumstances. (Para 24)
