Motor Vehicles Act, 1988 – Section 147 – MACT – Scope of coverage for passengers in goods vehicles – Liability of Insurer – The Motor Accident Claims Tribunal (Tribunal) allowed all claim petitions, holding the insurer liable to indemnify the owner. The appellants (insurer) challenged the awards, disputing the status of the deceased and the liability imposed on the insurer.
Upon examination of evidence, including the FIR and witness testimonies, the court found inconsistency in the accounts regarding the status of the deceased. The court observed that the evidence overwhelmingly supported the conclusion that the deceased were occupants of the tractor, rather than pedestrians.
Referring to relevant legal precedents, the court held that the insurer’s liability does not extend to passengers in goods vehicles unless specifically covered.
The court also addressed the issue of the driver’s lack of a valid driving license, concluding that the onus to prove the existence of a license rested with the owner, which was not established.
Consequently, the court allowed the appeals, setting aside the awards holding the insurer liable, and absolving the insurer from indemnification. (Para 32)
