Re-evaluating Contributory Negligence and Assessing Just Compensation in Motor Accident Claims

This batch of civil appeals arose from a common judgment passed by the High Court of Karnataka concerning a fatal motor vehicle collision that occurred on October 14, 2005, between a Hyundai Santro car and a KSRTC heavy passenger bus. The accident resulted in the tragic deaths of three passengers in the car (including the claimant’s husband and mother-in-law) and caused grievous injuries to the claimant, who survived.
