Testimonies of involved parties contradicted the FIR’s contents, undermining its reliability.
The Court emphasized the preponderance of probability standard in motor accident cases and rejected excessive reliance on the chargesheet and news item, both being hearsay evidence. Notably, the court referred to precedent judgments regarding the admissibility of such evidence.
Regarding compensation calculation, the Court upheld the consideration of gross salary, future prospects, and deductions per established legal principles. Additionally, it addressed the applicability of multipliers and conventional heads of compensation, aligning with Supreme Court precedents. The Court adjusted compensation figures based on legal precedents and factual circumstances.
Concerning insurance, the Court affirmed the insurance coverage and the validity of driving documents, dismissing claims of invalidity. The Court also upheld the awarded interest rate, citing relevant Supreme Court judgments. Compensation reduced from Rs. 16,44,820/- to Rs. 16,03,820/- (Para 16, 30, 33, 43, 48, 56, and 58)
