After examining the evidence, including witness testimonies and documentary proof, the Court held that the deceased’s income was wrongly assessed by the tribunal at Rs. 6,000/- per month. The Court determined a higher income based on rental agreements and discussions with witnesses, concluding that the deceased was running a goldsmith shop and earning approximately Rs. 10,500/- per month. Applying the principles of just compensation, the Court modified the award, enhancing it to Rs. 22,06,000/-, including loss of contribution, loss of estate, funeral expenses, and loss of consortium.
