The High Court of Himachal Pradesh dismissed an arbitration appeal filed under Section 37 of the Arbitration and Conciliation Act, 1996, seeking to set aside a District Judge’s judgment that had previously upheld an arbitral award. The Court reinforced that the scope of judicial review under Section 37 is extremely narrow and restricted, prohibiting courts from re-appreciating evidence, entertaining entirely new factual pleas, or substituting an alternative view unless the underlying award suffers from unpardonable perversity or patent illegality.
- Arbitral Proceedings and Award: The Managing Director of HPSFC appointed an Arbitrator to adjudicate a dispute regarding a shortfall of resin in Lot No. 9/2006 (Suket), who directed the non-claimant/appellant to deposit an amount of ₹5,07,517 with the claimant.
- Challenge Under Section 34: The appellant filed objections before the District Judge, Mandi, contending that her counter-claim and evidence were ignored, that climatic weather conditions and short working windows warranted a 50% rebate rather than the granted 10%, and that findings were self-contradictory. The District Judge dismissed these objections on March 20, 2015.
- Restricted Scope Under Section 37: Relying on Supreme Court precedents such as Konkan Railway Corporation Ltd. v. Chenab Bridge Project Undertaking and Bombay Slum Redevelopment Corporation Pvt. Ltd. v. Samir Barain Bhojwani, the High Court emphasized that an appellate court under Section 37 cannot act as a regular first appellate court or casually interfere with concurrent findings unless the Section 34 court misdirected its jurisdiction.
- Prohibition on New Factual Pleas: The Court observed that the appellant raised entirely new factual contentions before the High Court regarding 6,000 newly marked trees—arguments that were never raised before the Arbitrator—which is legally impermissible in a Section 37 appeal.
- Final Verdict: Because the appellant failed to point out any patent illegality going to the root of the matter or unpardonable perversity in the arbitral award, the appeal was dismissed, leaving the concurrent findings undisturbed.
