Requisitioning and Acquisition of Immovable Property Act, 1952 – Land Acquisition – Compensation – Arbitration Proceedings, Solatium, Interest, Delay, Constitutional Validity, Article 14, Fundamental Rights, Arbitrariness – In a case involving acquisition proceedings initiated by the Ministry of Defence under the Requisitioning and Acquisition of Immovable Property Act, 1952, the Supreme Court upheld the High Court’s decision to grant solatium and interest due to gross delay in the determination and payment of compensation.
Despite the absence of provisions for solatium and interest under the 1952 Act, the Court held that such compensation must be paid within a reasonable time from the date of vesting to avoid arbitrariness and uphold constitutional principles. Notably, the Court emphasized the responsibility of the Central Government to ensure prompt payment of compensation and attributed the delay in arbitration proceedings to the Government’s inaction. Consequently, the Court dismissed the appeals, affirming the High Court’s decision to award solatium and interest to the landowners. (Para 10)
