Himachal Pradesh High Court Judgment Summary
24th Sep, 2026
Revisional Limits and Statutory Presumptions in Cheque Dishonour Cases
This criminal revision petition was filed by the petitioner (accused) challenging the concurrent judgments of the lower courts convicting him under Section 138 of the Negotiable Instruments Act, 1881 (NI Act) and sentencing him to three months of simple imprisonment along with a fine of Rs. 1,75,000. The High Court dismissed the petition, reiterating that in revisional jurisdiction, the court cannot act as a second appellate court to reappreciate evidence in the absence of perversity. The court affirmed that once the execution and signature of a cheque are admitted, statutory presumptions under Sections 118 and 139 of the NI Act arise in favor of the holder, placing the heavy burden on the accused to rebut them with probable evidence.
