Himachal Pradesh High Court Judgments Summary

Establishing Title and Boundaries: Repercussions of Deficient Secondary Evidence and Unproduced Mutations in Mortgage Redemption
The appellants/defendants filed a regular second appeal against the judgment and decree of the District Judge (Forest) Shimla, which set aside the trial court’s dismissal of the plaintiffs’ redemption suit and ruled in favor of the plaintiffs. The dispute concerned whether a mortgaged property had been validly sold to the defendants via an old sale deed described by boundaries, and whether revenue entries and isolated jamabandi notes could establish title without producing the underlying mutation proceedings. The High Court of Himachal Pradesh dismissed the second appeal, affirming that an admission must be read as a whole and cannot confer title, that the 30-year presumption under Section 90 of the Evidence Act does not apply to certified copies or registration volumes without a proper foundation for secondary evidence, and that failure to connect boundary descriptions to the actual suit property or produce core mutation records is fatal to a claim of ownership.

Upholding Human Rights Mandates: Judicial Intervention for Timely Commission Appointments
An employee of M/s Ambuja Cements Limited filed a writ petition under Article 226 of the Constitution of India, aggrieved by the adjournment sine die of her human rights complaint concerning workplace sexual harassment. The proceedings stalled because the Human Rights Commission lacked the requisite quorum of members, and the State failed to fill vacant statutory posts for over a year. The High Court of Himachal Pradesh held that the State is statutorily mandated under the Protection of Human Rights Act, 1993, to make these appointments without prolonged delays. Invoking its plenary powers under Article 226, the Court directed the Chief Secretary of Himachal Pradesh to complete the appointment process for the Chairperson and members within six weeks, while issuing interim protection against the petitioner’s transfer until her complaint is finally adjudicated.
