The prosecution case revolves around the gang rape of the victim by the accused persons, which was reported immediately to the police and resulted in the registration of an FIR. Despite some witnesses turning hostile during cross-examination, their initial statements, along with the victim’s statement under Section 164 CrPC and medical evidence, provided sufficient corroboration to the prosecutrix’s version of events.
The Supreme Court held that the delay in cross-examination may have influenced witness testimony, but the evidence as a whole, including the FIR, the statement under Section 164 CrPC, and medical evidence, corroborated the victim’s account. The judgment of Rai Sandeep alias Deepu v. State (NCT of Delhi) was distinguished from the present case due to differences in medical evidence.
Consequently, the Supreme Court found no reason to interfere with the concurrent findings of fact recorded by the trial court and the High Court. The appeal was dismissed. (Para 17)
