Nursing courses as per the Notice Inviting Expression of Interest issued by the Respondent-State. Despite fulfilling the criteria for the courses, the petitioner’s application faced hurdles due to discrepancies found by the Directorate Level Evaluation Committee, referencing a policy dated 29.09.2020, which had been previously deemed insignificant by the court in earlier judgments.
The petitioner, through Right to Information Act, discovered that its institution had been recommended for starting the courses by the Sub Divisional Level Inspection Committee but faced obstacles at the Directorate Level. The State’s insistence on the applicability of the 2020 policy despite judicial rulings against it raised concerns of bias and arbitrariness.
The court emphasized that executive actions must align with statutory laws and cannot override them, citing legal precedents.
Interim relief was granted, directing the State to issue a provisional No Objection Certificate, which was later found to be unfairly limited to only five student admissions, indicating bias. The court criticized the State’s approach to assessing applications, calling for transparent and objective criteria for issuing No Objection Certificates.
Finally, the court ruled in favor of the petitioner, directing the State to issue No Objection Certificate and Essentiality Certificate for running the courses with an annual intake of 60 students each, emphasizing adherence to legal principles and transparent procedures. (Para 31)
