Ministry of Environment and Forests – Notification dated 14 September 2006 – Environmental Clearance – Environmental Impact Assessment – Violation of Environmental Laws – Environmental Governance – The Supreme Court, in an appeal arising from an order of the National Green Tribunal (NGT), addressed the issue of environmental clearance for the establishment of a greenfield airport in Silchar, Assam. The National Green Tribunal[ NGT], by its order dated 25 January 2024, dismissed the OA. The NGT held that an Environmental Impact Assessment Report was awaited and the Environmental Clearance for the airport has not been granted. Yet it held that the plea of the appellants for an order of restraint on the grant of site clearances and in principle approvals was without merit at that stage.
Despite the absence of an environmental clearance, extensive clearance activities were carried out, including the uprooting of tea bushes and shade trees. The NGT’s dismissal of the case without verifying the authenticity of the appellants’ grievance was criticized by the Court, emphasizing the Tribunal’s duty to safeguard the environment and ensure due diligence in adjudication.
The Supreme Court held that the activities conducted were in violation of environmental laws, specifically paragraph 2 of the notification dated 14 September 2006, which mandates prior environmental clearance for certain projects. Emphasizing the importance of environmental regulations in sustainable development, the Court directed that no further activities in breach of environmental laws be carried out at the proposed airport site. Additionally, the processing of any future environmental clearance applications should consider the site’s condition before the illegal clearances took place. Consequently, the Court allowed the appeals and set aside the NGT’s order. (Para 25)
