The High Court of Himachal Pradesh dismissed a criminal revision petition and upheld a Family Court order that directed an able-bodied father to pay ₹10,000 per month as maintenance to his minor daughter. The Court held that an able-bodied father cannot evade his sacrosanct statutory obligation to maintain his minor child under Section 125 of the CrPC merely by pleading unemployment, unless he proves total bodily incapacitation, nor can he resile from solemn undertakings given during mutual divorce proceedings.
- Unemployment Plea Rejected: An able-bodied father cannot escape his statutory obligation to support his minor child on the ground of unemployment unless he demonstrates physical disability or incapacity to earn through labor.
- Binding Undertaking in Divorce Proceedings: During mutual divorce proceedings under Section 13-B of the Hindu Marriage Act, the father had explicitly undertaken to abide by the final verdict of the Family Court in the pending Section 125 CrPC proceedings, rendering his subsequent challenge an abuse of the judicial process.
- Reasonableness of Maintenance: Considering the child’s educational expenses (tuition and transportation), food, clothing, medical needs, and the rising cost of living, the awarded sum of ₹10,000 per month was deemed fair, just, and commensurate with her growing needs.
- Scope of Revisional Jurisdiction: In the absence of any patent illegality, impropriety, or irregularity in the Family Court’s proceedings, interference under Section 19(4) of the Family Courts Act was unwarranted
