The Trial Court and the Revisional Court held that the delay in filing the complaint was permissible under Section 470(3) of Cr.P.C., and the person issuing the sanction held different capacities, thus not invalidating the sanction.
The petitioner contended that obtaining prosecution sanction was unnecessary as per Section 32 of the Drugs and Cosmetics Act, which doesn’t mandate such sanction for offences under Chapter IV.
The Court held that since no sanction was required, the argument regarding the same person issuing the sanction and conducting the raid was irrelevant.
The Court emphasized that the limitation period for filing the complaint started from the date the Drug Inspector received information about the alleged offences, not from the date of obtaining prosecution sanction.
The Court referred to Section 468(2)(c) of Cr.P.C., which provides a limitation period of three years for offences punishable with imprisonment exceeding one year but not exceeding three years.
It was observed that the complaint was filed beyond the three-year limitation period, rendering it time-barred.The Court rejected the contention that executive instructions from the Central Drugs Standard Control Organization superseded statutory provisions, emphasizing the primacy of the law over guidelines.
