The complainant, a proprietorship firm, alleged that the accused, directors of a company, issued cheques that were dishonoured due to insufficient funds. Despite legal notices, no payment was made, leading to the filing of a complaint. The learned Trial Court found sufficient reasons to proceed against the accused and issued summons.
The petitioner challenged this order, arguing that the complainant’s status as a proprietorship firm and the authorization for filing the complaint were improper. Additionally, it was contended that filing a single joint complaint for multiple dishonoured cheques was impermissible. However, the respondent contended that the complainant was a private limited company and had proper authorization to file the complaint. They argued that a joint complaint for multiple cheques was permissible under Section 219 of the Cr.P.C.
After considering the arguments, the Court referred to established legal principles outlined in various judgments. It emphasized that the power under Section 482 should be exercised sparingly, and a mini-trial should not be conducted at this stage. The Court cannot delve into the reliability of the evidence but must determine if the allegations, on their face value, constitute an offence. It reiterated that a single complaint for multiple cheque dishonours was maintainable under Section 219 of the Cr.P.C.
Furthermore, the Court held that a complaint cannot be quashed merely due to improper authorization, as it can be rectified at a later stage. The issue of signature on cheques would be examined during trial and cannot be adjudicated at this preliminary stage. (Para 9)
