Negotiable Instruments Act, 1881- Section 138 – Code of Criminal Procedure, 1973 – Section 311- Criminal Procedure – Production of Document – Essentiality of evidence – Just decision – Fair trial
Interest of justice – The present petition involves the quashing of an order passed by the learned Trial Court allowing an application under Section 311 of the Code of Criminal Procedure (Cr.P.C.) for the production of documents in a case relating to an offence under Section 138 of the Negotiable Instruments Act.
The petitioner, accused of not depositing sale proceeds and issuing a cheque in discharge of the liability, challenged the order, contending that the application was not maintainable and that the documents were not necessary. The Hon’ble Court, after considering submissions from both parties, observed that the power under Section 311 of Cr.P.C. encompasses the summoning of witnesses and production of documents deemed essential for a just decision. Citing precedents, it emphasized that the court’s role is to ensure the discovery of truth and the administration of justice, even if it means filling up lacunae left by the prosecution.
The court rejected the argument that allowing the application would fill loopholes, stressing that the focus should be on the essentiality of evidence. The judgment underscores the wide discretion of the court to summon witnesses and produce documents at any stage, guided by the pursuit of justice and the right to a fair trial. Consequently, the petition was dismissed, affirming the validity of the Trial Court’s order. (Para 10, 12, 13, 16)
