Himachal Pradesh Water Cess on Hydropower Generation Act, 2023 – Constitutional Validity – Water Cess – The petitioners, power generation companies operating hydropower projects in Himachal Pradesh, challenge the constitutional validity of the Himachal Pradesh Water Cess on Hydropower Generation Act, 2023 (the “Act”), alleging lack of legislative competence of the State Government. Petitioners contend that the State Government lacks authority under Article 265 of the Constitution of India to levy the water cess as it does not find mention in List-II (State List) of the Seventh Schedule. Additionally, petitioners argue that even if entry 17 of List-II were to empower the State Government to levy such a tax, it would be in contravention of Article 288 of the Constitution due to non-compliance with its provisions. The Act purportedly encroaches upon the legislative powers of the Union Government concerning interstate rivers, violating Article 288 as well as Entry 56 of List-I (Union List). Furthermore, petitioners assert that since most of the hydropower projects are situated on interstate rivers, the State lacks jurisdiction to legislate on such matters.
Held: it is absolutely clear that the impugned Act imposes tax on generation of electricity and not merely on water as a subject or on drawl of water, which the State is not competent to do. It also imposes an inter-State tax on inter- State supply of electricity for which again the State is not competent to do so. The provisions of the Himachal Pradesh Water Cess on Hydropower Electricity Generation Act, 2023, are declared to be beyond the legislative competence of the State Government in terms of Articles 246 and 265 of the Constitution of India and, thus, ultra vires the Constitution and so quashed.
