The High Court dismissed a petition seeking pre-arrest bail filed by the petitioner, who was accused of possessing a commercial quantity of heroin under the NDPS Act. The petitioner was allegedly found to be in possession of a backpack containing heroin, as evidenced by CCTV footage and police investigation. The court noted that the quantity of heroin recovered from the petitioner constituted a commercial quantity, invoking the strict provisions of Section 37 of the NDPS Act.
Referring to legal precedents, the court emphasized that possession includes the exercise of control over the contraband, regardless of physical proximity. Therefore, the petitioner’s control over the backpack containing heroin amounted to possession.
The court highlighted that the petitioner had been declared a proclaimed offender by a competent court, citing legal precedents that such individuals are not entitled to pre-arrest bail.
