The agreement included the payment of Rs. 10,00,000/- by the husband to the wife as permanent alimony, withdrawal of all future maintenance claims by the wife, custody arrangement for their children, and withdrawal of all pending legal cases.The husband had already paid the agreed amount towards alimony, and the parties jointly filed an application for dissolution of marriage under Section 13(B) of the Hindu Marriage Act.
Decision: The impugned judgment of the District Judge, Family Court, Mandi, was set aside, and the petition filed by the respondent/husband was converted into a joint petition under Section 13(B) of the Hindu Marriage Act for dissolution of marriage with mutual consent. The marriage was dissolved with mutual consent, and the terms of the agreement were incorporated into the decree. (Para 10)
