Service Law – Transfer – The petitioner, Tara Chand Sharma, filed a writ petition seeking to quash the cancellation of his transfer order. The petitioner had been transferred from GSSS Purag to GSSS Mashobra on his own request due to family hardships, which was approved by the competent authority. However, the transfer order was subsequently cancelled. The petitioner challenged the cancellation on grounds of arbitrariness, malafide, and violation of constitutional rights. There was no provision in the Policy, which permitted the clubbing of the previous stay of an employee – This decision making process, leading to issuance of the cancellation orders, by ignoring relevant aspects i.e. short stay and by ignoring fulfillment of twin pre-conditions of public interest and administrative exigency is absent, in the instant case which is verified by record.
The cancellation order was set aside, and the petitioner was directed to continue in his transferred position. The Court also allowed the respondent to represent any hardships for further consideration. (Para 12 to 16)
