The High Court considered two separate revisions, one by the informant-complainant and the other by the State, challenging the order of the Trial Court which discharged the accused, respondent No.2, from the offence punishable under Section 306 of the Indian Penal Code
The informant contended that there was sufficient material on record to frame charges against the accused, asserting that the accused had harassed the deceased to the extent that he felt compelled to commit suicide. The State, in its revision, argued that the Trial Court erred in evaluating the evidence at the stage of framing charges, contending that the statements and circumstances on record were adequate to proceed with the trial.
The High Court, after careful consideration of the submissions and evidence on record, held that the Trial Court’s approach was flawed. It emphasized the principle laid down by the Supreme Court that at the stage of framing charges, the Court’s task is to determine whether there is a prima facie case to proceed with the trial, without delving into the depth of evidence or evaluating its veracity. The Court observed that the statements of witnesses, coupled with circumstantial evidence, prima facie established that the accused had harassed the deceased, creating circumstances that led him to take his own life.
The Court highlighted the essence of abetment under Section 306 IPC, emphasizing that instigation could be inferred from the accused’s conduct or continuous course of action that compels the victim to commit suicide. Mere allegations of harassment, without evidence of actions proximate to the time of occurrence, may not sustain a conviction under Section 306 IPC. However, in the present case, the evidence suggested a pattern of harassment by the accused, leading to the deceased’s suicide.
In light of these observations, the Court allowed the revisions, setting aside the Trial Court’s order and remitting the matter for framing charges under Section 306 IPC. The parties were directed to appear before the Trial Court for further proceedings. (Para 28)
