Contempt of Courts Act, 1971 – Sections 2(c)(ii), 2(c)(iii), and 12 – Criminal Contempt – Tampering with Court record – Fabricated documents – Interference with administration of justice – The respondents, in their appeal before the court, submitted a certified copy of a judgment and decree purportedly obtained from the First Appellate Court, wherein they tampered with the dates of attestation and delivery. This manipulation was uncovered during subsequent proceedings.
Despite the respondents’ claims of innocence, evidence clearly established their involvement in the tampering. The Court held that such acts constitute criminal contempt as defined under Sections 2(c)(ii) and 2(c)(iii) of the Contempt of Courts Act, 1971. By fabricating documents and providing false information to the Court, the respondents interfered with the due course of judicial proceedings and obstructed the administration of justice. Therefore, the Court imposed appropriate penalties, including community service, fines, and exemplary costs, upon the respondents for their contemptuous behavior. (Para 5)
