The impugned order, issued on 10.01.2023, was not published in the Official Gazette despite being in force for more than thirty days, contravening the mandatory requirement of Section 115. The Court held that any notification/order under Section 115, to remain effective beyond thirty days, must be published in the Official Gazette. As the order continued beyond the stipulated period without publication, it violated the statutory provisions. Thus, the Court quashed the impugned order, emphasizing that its annulment wouldn’t preclude the authority from issuing a fresh notification in accordance with the law. (Para 10)
