The decision on legal representation under Order 22 Rule 5 of CPC is solely for the limited purpose of representation in the case and does not confer any property rights.
The Court underscored the significance of proper procedure, highlighting that the appellate court may consider the findings of a subordinate court but retains discretion in determining the legal representative. In the instant case, the High Court erred in its interpretation of the rule and the previous order of the Supreme Court, failing to consider objections and pending applications. Consequently, the Court set aside the orders and remitted the matter to the High Court for a fresh decision on substitution, reiterating that the decision pertains only to procedural matters and not the merits of the claims.
