Supreme Court Rules, 2013, Rule 5 of Order XV; Rule 2(1), Rule 4, Order XLVIII – Curative petition – Jurisdiction of the Registrar to decline registration of a curative petition – Challenge as to –Held that Registry cannot be vested with power to decide whether a review petition, after being dismissed in open Court hearing, merited relook through the curative jurisdiction -That would be a judicial exercise – The Registry in a situation of this nature, cannot keep the matter pending as “defective” either, as is done in the cases of delayed filing of petition unaccompanied by applications for condonation of delay – Curing the defect would not be within the Registry’s jurisdiction – Held that the course prescribed in Rule 5 of Order XV; Rule 2(1), Rule 4, Order XLVIII was not followed when the order was passed declining registration of the curative petition – This order held to be contrary to the provisions of the Rules and impugned order liable to be set aside – Do not consider it fit to remand the matter to the Registrar as the curative petitions were filed in the year 2020 and substantial time has lapsed since then – Curative petitions as well perused -Do not think any case has been made out by the appellant for invoking the curative jurisdiction to take relook into the appellant’s case – Hence, refrain from entertaining the curative petitions.
