In this writ petition, the High Court of Himachal Pradesh examined the mandatory timelines for land acquisition under Section 19 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. The Court held that under Section 19(7), a preliminary notification is deemed to have been rescinded if no declaration under Section 19(1) is made within 12 months. While the appropriate Government holds the power to extend this period, the third proviso strictly requires the decision and detailed reasons to be recorded in writing, notified, and uploaded on the official website. Because the extensions granted by the State relied on bald, non-speaking notifications citing vague administrative delays without recording concrete reasons either in official files or notifications, the Court ruled the extensions bad in law. Consequently, the preliminary notification was declared to have lapsed and deemed rescinded under Section 19(7).
- Mandatory 12-Month Period: Under Section 19(7) of the 2013 Act, failing to issue a declaration under Section 19(1) within 12 months from the preliminary notification results in the automatic lapsing and deemed rescission of the notification.
- Requirement of Recorded Reasons for Extension: Although the appropriate Government can extend the 12-month period, the third proviso to Section 19(7) mandates that the decision and concrete reasons must be recorded in writing, notified, and uploaded to the website.
- Invalidity of Non-Speaking Extensions: Bald and generic notifications extending time due to vague administrative circumstances or general failure to finalize rehabilitation plans—without backing reasons in official records or notifications—fail legal scrutiny.
- Consequence of Statutory Breach: Due to the blatant non-compliance with mandatory recording requirements over a span of more than three and a half years, the preliminary notification (Annexure P-1) and its subsequent extensions (Annexures P-3 to P-5) were set aside and held to be deemed rescinded.
