The High Court of Himachal Pradesh dismissed the State’s criminal appeal and upheld the acquittal of the respondents under Section 20 of the Narcotic Drugs and Psychotropic Substances (NDPS) Act. The Court ruled that when police records and witness statements describe the seized contraband as “sticks,” but the State Forensic Science Laboratory (SFSL) report reveals a mixture containing a chapatti and poly-wrapped fused sticks mass, it creates a fatal missing connecting link regarding the identity of the sample. Coupled with interpolations of FIR numbers on spot documents and unexplained contradictions in official testimonies, the prosecution failed to prove its case beyond reasonable doubt, thereby reinforcing the presumption of innocence in favor of the accused.
- Discrepancy in Contraband Description: While the police seizure memos, identification forms, and testimonies consistently described the seized Charas as being in the “shape of sticks,” the SFSL report analyzed an entirely different mixture containing a chapatti and fused stick mass, leaving a missing connecting link that rendered the forensic findings unreliable.
- Flawed Documentation and Interpolation: Documents prepared at the spot (such as seizure and seal-handing memos) exhibited clear evidence of subsequent interpolation of FIR numbers written later in different inks or over blank spaces, casting serious doubt on the veracity of the police version.
- Contradictory Official Testimony: The official witnesses gave conflicting accounts regarding their initial deployment for patrolling or tracking timber smuggling, and photographs from the scene unexplainably depicted an unverified third person in civil clothes despite claims that only the two accused were present.
- Acquittal Upheld: Because an order of acquittal reinforces the presumption of innocence, and the State failed to point out any overlooked cogent evidence or perversity in the trial court’s findings, the appeal was dismissed and the respondents were directed to furnish bail bonds under Section 481 of the Bharatiya Nagarik Suraksha Sanhita, 2023.
