MACT: Navigating Just Compensation: Reassessing Multipliers, Future Prospects, and Filial Consortium
In this appeal filed under Section 173 of the Motor Vehicles Act, 1988, the High Court of Himachal Pradesh addressed challenges raised by the Bajaj Allianz General Insurance Company against a Motor Accident Claims Tribunal (MACT) award granting compensation for the death of a 20-year-old bachelor in a vehicular accident. The High Court firmly rejected the insurance company’s belated attempt to introduce a new plea of drunken driving for the first time at the appellate stage without any foundational pleadings before the Tribunal. While modifying the total compensation, the Court clarified critical legal principles regarding the computation of notional income in the absence of documentary proof, the application of future prospects for self-employed individuals under 40, determining multipliers based strictly on the age of the deceased rather than the claimants, applying standard deductions for bachelors, and periodically enhancing conventional heads with triennial revisions.
