This civil appeal arose from an award passed by the District Judge (Forests), Shimla, concerning land acquisition for road construction where the State took physical possession of the claimant’s land years before issuing the formal notification under Section 4 of the Land Acquisition Act. The High Court of Himachal Pradesh addressed the landowner’s entitlement to use and occupation charges for the delayed acquisition as well as the correct timeline for calculating statutory interest. Relying on established precedents, the Court modified the reference court’s award by granting additional interest by way of damages at the rate of 15% per annum from the year of dispossession (1990) until the Section 4 notification date (May 17, 2007), and clarified that statutory interest should commence from the date of the Section 4 notification rather than the Collector’s award date.
- Damages for Premature Dispossession:
- Where the State utilizes and takes possession of a landowner’s property long before the issuance of a Section 4 notification under the Land Acquisition Act, the landowner is entitled to additional interest by way of damages for remaining out of possession.
- The appellant was awarded additional interest at the rate of 15% per annum for the period starting from actual dispossession in 1990 until the issuance of the Section 4 notification on May 17, 2007.
- Commencement and Rate of Statutory Interest:
- The Reference Court erred in commencing statutory interest from the date of the Collector’s award.
- The claimant is entitled to statutory interest at the rate of 9% per annum from the date of issuance of the notification under Section 4 (May 17, 2007) for the first year, and thereafter at the rate of 15% per annum until the actual payment or deposit of the compensation amount.
