This writ petition challenged major penalty disciplinary orders passed against the petitioner, who was serving as a Patwari, by the Deputy Commissioner, Mandi. The petitioner argued that following a formal government notification dated February 22, 2025, issued in the name of the Governor, various revenue cadres (including Patwaris) were converted into a State Cadre, designating the Director, Land Records as the sole appointing and disciplinary authority. Consequently, the Deputy Commissioner lacked jurisdiction to penalize him. Although the State defended the action based on a subsequent departmental clarification letter issued by the Director, Land Records attempting to preserve the old system until new Recruitment and Promotion (R&P) rules were finalized, the High Court held that a subordinate administrative communication cannot alter or supplement a formal government notification issued by the competent authority. The disciplinary and appellate orders were accordingly quashed, though the State was granted liberty to initiate fresh proceedings through the proper designated authority.
- Supremacy of Formal Government Notifications: A formal notification issued in the name of the Governor by the competent Secretariat authority holds superior legal weight and cannot be modified, interpreted, or supplemented by a subordinate departmental communication.
- Vesting of Disciplinary Jurisdiction: When employee cadres (such as Patwaris) are converted into a State Cadre via official notification, the power to initiate or conclude disciplinary proceedings shifts exclusively to the newly designated appointing and disciplinary authorities specified therein.
- Nullity of Unauthorized Orders: Disciplinary actions or major penalties imposed by erstwhile authorities after a cadre-conversion notification takes effect are legally unsustainable and void ab initio.
- Liberty for Proper Redress: While flawed orders passed by incompetent authorities are liable to be set aside, the administration retains the liberty to pursue departmental proceedings afresh, provided they are conducted strictly through the legally competent authority under the governing notification.
