The High Court of Himachal Pradesh allowed a civil revision petition and set aside an appellate court order that had dismissed a civil appeal as time-barred. The Court ruled that when the High Court previously granted liberty to approach the District Court and directed that the pendency of proceedings before the High Court be counted for the benefit of Section 14 of the Limitation Act, a lower appellate court cannot dismiss the subsequent appeal on limitation grounds by insisting on a separate Section 5 application or by adopting a hyper-technical approach.
- Protection of Time Spent in Good Faith: Where the High Court explicitly safeguards the period spent prosecuting a matter before an incorrect forum due to pecuniary jurisdiction, that protected period must be excluded under Section 14 of the Limitation Act without requiring a separate formal application.
- Rejection of Hyper-Technical Dismissals: The lower appellate court committed an error by adopting a shortcut method to dismiss the appeal on limitation after having already issued notices to the respondent, defeating the fundamental right of a litigant to have an appeal decided on merits.
- Remand for Expeditious Decision: The impugned order dated December 30, 2010, was set aside, and the matter was remanded back to the First Appellate Court with instructions to hear and decide the appeal on merits within one month, with parties directed to appear on September 22, 2026.
